Pursuant to section 40 of The Legislative Assembly and Executive Council Act, 2007, Harry Van Mulligen of the New Democratic Party vacated his seat in the constituency of Regina Douglas Park on June 30, 2009. On Monday, August 24, 2009, pursuant to an Order of the Lieutenant Governor in Council, a Writ of Election was issued by the Chief Electoral Officer to Noel Selinger, constituency Returning Officer. The Writ ordered that the by-election be held on Monday, September 21, 2009.
